Creator Platform Terms of Use
The rules for using GAMPEON as a player, creator or project owner: who is responsible for what, your rights in your content, reports and moderation.
Closed beta version. These rules apply during the closed beta and may still change before GAMPEON opens to everyone. We will tell you before important changes take effect.
Service provider: Gampeon, Inc. · 651 N Broad St, Suite 206, Middletown, DE 19709, USA
General contact: hello@gampeon.com · Legal/content reports: abuse@gampeon.com
These Terms apply to GAMPEON's services for players and creators: gampeon.com and the portal, the GAMPEON launcher, game servers listed on GAMPEON, the developer docs, the APIs and the creator tools. Capitalized terms have the meanings below. Any mandatory legal rights prevail over conflicting terms.
1. Service and roles
GAMPEON provides technical services through which users may create, host, publish, distribute and access games, experiences, virtual worlds, 3D assets, scripts, modifications and associated user-generated content (“UGC”). Specific features are available only where activated. “Platform Operator” means Gampeon, Inc.; “Project Owner” means an account or studio administering a game, world or project; “Uploader” means the person who actually submits particular UGC; “User” includes players, creators and Project Owners.
GAMPEON is not the author, seller, publisher in its own name, licensor of underlying intellectual property, or endorser of UGC merely because it provides hosting, distribution, search, technical conversion or moderation tools. Where GAMPEON expressly creates, offers, endorses or sells its own content, its responsibilities for that content are unaffected.
2. Eligibility and minors
Users must be at least 13 years old. Users under 18 may use the service only to the extent permitted by applicable law and with a parent or legal guardian's agreement or authorization where required. Privacy-law consent thresholds differ by jurisdiction and may require verifiable parental authorization. GAMPEON may restrict age-sensitive experiences, communication, publishing, transactions and account features. Persons under 18 cannot independently enroll in payout programs unless a separately approved lawful arrangement permits it. GAMPEON asks for the month and year of birth when an account is created. Accounts of users under 16, and accounts without a date of birth, get stricter default settings for contact and visibility. Buying GAMPEONS is currently limited to users aged 18 or older. Parents/guardians who lawfully authorize use should supervise the minor's activities; mandatory legal protections for minors remain unaffected.
3. Account, identity and security
Users must provide accurate required details, safeguard credentials, not impersonate others, and report compromised accounts promptly. Commercial creators must provide accurate business and tax details where required. Accounts and privileges may not be transferred without permission. GAMPEON may apply proportionate verification, security and abuse-prevention measures.
4. The three levels of UGC responsibility
(a) Uploaders. The Uploader, not GAMPEON, selects and provides their UGC and is primarily responsible under applicable law for obtaining all necessary intellectual-property rights, permissions, clearances and lawful grounds for its publication, distribution and commercial exploitation. The Uploader warrants that their submission and its authorized use will not unlawfully infringe third-party rights and will comply with applicable law and Platform policies.
(b) Project Owners. A Project Owner is responsible for their own UGC, project policies and content they deliberately publish, commission, approve or control. A Project Owner does not automatically become the creator or rights holder of player-uploaded UGC merely because it appears inside their game or world. The legal responsibility of a Project Owner for third-party uploads depends on their actual role, knowledge, control, actions and applicable law. Where they can restrict particular content and are credibly notified of a violation, they must cooperate with GAMPEON and take reasonably necessary measures within their control. Project Owners must not knowingly encourage or preserve infringing content.
(c) GAMPEON. GAMPEON provides an intermediary/hosting service for eligible third-party content. For content stored at users' request, the statutory hosting liability exemptions may apply when their conditions are fulfilled, including acting expeditiously upon actual knowledge or legally sufficient notice. GAMPEON retains its own statutory duties, including notice-and-action, required notifications, user remedies and compliance with lawful orders. These Terms do not create immunity where the law does not allow it.
5. UGC ownership and limited platform license
Creators retain the intellectual-property rights they actually own in their original UGC. Uploading does not transfer ownership to GAMPEON or a Project Owner. By uploading or publishing UGC, the rights holder grants GAMPEON a worldwide, non-exclusive, royalty-free license, solely to the extent reasonably necessary to host, reproduce, technically process, adapt for compatibility, transmit, stream, display, distribute, back up, secure, moderate and promote the UGC as part of the GAMPEON services and its discovery features. This includes necessary service providers acting on GAMPEON's behalf. No blanket transfer of copyright or general right to sell standalone UGC outside the service is granted. The license ends upon removal except for technically necessary limited backups, compliance records, previously lawfully granted user access, and other rights that lawfully survive. GAMPEON will not use UGC to train generative AI models without a separate authorization from the relevant rights holder.
Other users receive only the limited permissions necessary to access and play an experience. They may not extract, copy, reupload, resell or commercially reuse assets unless the rights holder expressly permits this through a valid license. A creator cannot grant broader rights in third-party material than they hold.
6. Brands, copyrighted works and third-party assets
Uploaders must hold suitable rights for every component they distribute, including trademarks, logos, music, likenesses, characters, maps, vehicles, scripts and marketplace assets. A license to include an asset in a finished game does not necessarily authorize distributing the source file or standalone asset. Technical access or the ability to extract game files is not permission. Uploading leaked, pirated, stolen or otherwise unauthorized game assets is prohibited. Brand references that are lawful, descriptive or otherwise permitted by law are not categorically forbidden; rights complaints are evaluated case by case. Creators are responsible for required attributions and license notices.
7. Project administration and player uploads
Project Owners may establish additional in-world rules consistent with applicable law and GAMPEON policies. They must offer or enable reasonable reporting and moderation cooperation where their project allows player submissions. They may remove or restrict content within their control, but may not promise to override GAMPEON's legal decisions. Project Owners should preserve evidence and report clear infringement or dangerous content through available Platform tools rather than ignoring notice. Disputes among team members about their own intellectual-property contributions remain the parties' responsibility unless legal process requires GAMPEON's involvement.
8. Safety and prohibited uses
Users may not submit illegal content; child sexual abuse material; grooming; unlawful hate or threats; non-consensual intimate images; doxxing; fraud; unlawful gambling; malware, spyware, backdoors or credential theft tools; stolen intellectual property; or material intended to exploit the service, users or networks. No unauthorized scraping of protected user data, privacy invasion, rights circumvention, artificial rankings, or deceptive monetization. Fictional themes or lawful commentary are not automatically banned; content ratings, age restrictions and community standards may apply. See the UGC & Community Guidelines.
9. Reporting, notice and action
Any person may report allegedly illegal content through GAMPEON's accessible reporting mechanisms (the Report buttons and the report form) and/or abuse@gampeon.com. Complaints should identify the exact content location, alleged violation, supporting facts and a contact method, subject to statutory exceptions. GAMPEON may investigate, request evidence, preserve relevant records, temporarily disable access, remove a specific asset, restrict a project, or suspend an account when warranted. Merely forwarding a credible report to a creator does not discharge GAMPEON's own legal duties. GAMPEON will process legally relevant notices diligently, objectively and without undue delay, and will communicate relevant decisions, reasons and remedies as applicable. Rights holders and uploaders may use the separate Copyright, Trademark & Notice-and-Action Policy. A report does not automatically prove infringement.
10. Copyright, trademark and disputes
Copyright and trademark are distinct rights. US copyright notifications and counter-notices may be handled under the DMCA where applicable; trademark reports are assessed under applicable trademark law, the DSA and GAMPEON policy, not automatically under DMCA counter-notice rules. GAMPEON does not undertake to adjudicate private commercial ownership disputes beyond what is legally required. It may request proof of licensing, refer parties to one another where lawful, or comply with a valid binding order. Personal data will be disclosed only where lawful and necessary; submitting a report does not automatically authorize GAMPEON to reveal a reporter's personal information publicly.
11. Moderation, appeals and repeat infringers
Proportionate measures may include warnings, content restrictions, age-rating changes, temporary disabling, removal, project restrictions and suspension or termination. Decisions will reflect context, seriousness, recurrence and available evidence. Users will receive a statement of reasons and access to applicable complaint and judicial remedies where required. For services subject to DSA Article 20, the required internal complaint system will be available for at least six months following the decision; exemptions may apply to qualifying small/micro platforms. Persistent or serious repeat infringement may result in permanent account termination. Users must not evade enforcement through new accounts.
12. Security and external services
Developers are responsible for securing their own software, scripts, integrations and project-side processing. No malicious executable code or unauthorized collection of personal data is permitted. Third-party engines, asset stores and APIs retain their independent terms. GAMPEON may scan or quarantine content in good faith for security and legal compliance without assuming authorship of it.
13. Monetization and digital items
Paid features, creator earnings, virtual items, commissions and payouts apply only if separately launched and accepted under the GAMPEON Creator Monetization Terms. Fees, seller identity, tax responsibilities, refund conditions and any consumer withdrawal exceptions must be shown as required before purchase. No earnings or traffic are guaranteed. Access to digital content does not transfer underlying copyright. GAMPEONS bought with money can never be paid out, exchanged back for money or transferred to other users. Only GAMPEONS that a creator earns as a license fee under the Creator Monetization Terms can be paid out.
14. Data and privacy
GAMPEON handles user data according to its Privacy Policy. Creators who independently decide to collect or use player data may have their own GDPR or other privacy-law duties and must not imply that GAMPEON's privacy notice covers independent third-party data processing. Reports and counter-notices may require legally necessary disclosures to the parties, authorities and advisors, with data minimization.
15. Liability: platform, project owners and individuals
To the maximum extent permitted by applicable law, neither GAMPEON nor a Project Owner is responsible solely because third-party UGC is technically hosted, rendered or accessible through their respective services or projects. This does not exempt either party from its own conduct, control, knowledge, legally required response to notices, contractual obligations, or statutory liability. GAMPEON provides third-party UGC without independent warranties as to its rights, legality, accuracy, safety or fitness. Nothing excludes liability that cannot lawfully be excluded, including mandatory consumer rights and liabilities for intentionally unlawful conduct, or injury/death where applicable.
GAMPEON's directors, officers, employees and shareholders do not, merely by holding those roles, become personal contracting parties under these Terms. This provision cannot prevent personal responsibility arising under applicable law, personal guarantees or a person's own unlawful actions. Proper corporate separation and compliance remain necessary.
16. Indemnification (business creators)
To the extent permitted by mandatory law, a business Uploader or business Project Owner must defend and indemnify GAMPEON against reasonably evidenced third-party claims, damages and reasonable legal costs to the extent directly caused by that party's culpable unlawful UGC publication, infringement of third-party rights, or material violation of these Terms. GAMPEON must give timely notice, reasonably cooperate, and may not agree to a settlement imposing obligations on the indemnifying party without its consent, not unreasonably withheld. No indemnity applies to losses caused by GAMPEON's own conduct or to matters the party did not cause. For consumers, including minors, statutory law governs liability; no blanket indemnity is imposed merely by using the service. Such indemnification does not prevent rights holders from raising claims directly against GAMPEON where law permits.
17. Availability, changes and termination
Services may change, be interrupted or end for technical, legal or business reasons. Material service or contract changes will be communicated with legally required notice. Users may stop using the service, remove their content where possible, and exercise mandatory data rights. GAMPEON may terminate for material breach subject to applicable reasons, notice and appeal requirements. Technical backups, valid existing licenses and lawful records may persist for limited lawful purposes.
18. Applicable law and legal remedies
These Terms are governed by Delaware law to the extent permitted. This choice does not deprive EU consumers of non-waivable protections under the laws of their habitual residence or limit jurisdiction mandated by applicable law. Nothing waives applicable DSA rights, GDPR rights, consumer remedies or other mandatory protection. If one term is unenforceable, the remaining provisions continue to apply where legally permissible.
