Copyright, Trademark & Notice-and-Action Policy
How to report content that infringes copyright or trademarks or is otherwise illegal, and how GAMPEON handles reports, counter-notices and appeals.
Closed beta version. These rules apply during the closed beta and may still change before GAMPEON opens to everyone. We will tell you before important changes take effect.
Report contact: abuse@gampeon.com or the online report form.
This policy applies to alleged infringement in UGC and other potentially illegal content hosted through GAMPEON.
1. Distinct complaint pathways
Copyright: Claims concerning copied code, art, music, videos, game assets, maps or other protected works. For notices governed by US law, the Digital Millennium Copyright Act (DMCA) process may apply.
Trademark: Claims concerning unauthorized brand names, logos and other signs. These are assessed under the applicable trademark law and the EU Digital Services Act where applicable; a DMCA copyright counter-notice procedure is not automatically the trademark procedure.
Other illegal content: Use the Platform's general DSA notice mechanism.
2. How to send a report
Reports should include, as relevant:
- The reporter's name and contact email (subject to applicable statutory exceptions).
- Whether the reporter is the rights holder or authorized representative.
- The protected work or trademark, with ownership/registration details where available.
- The exact GAMPEON URL, asset ID, project ID or other reliable location of the contested content.
- What is allegedly unlawful and why, including the particular right and territory where relevant.
- Evidence or links to the original work; relevant licenses or registration documents if available.
- A good-faith declaration that the information is accurate and complete.
- For a formal US DMCA copyright notice, the identification, signature and sworn authorization statements required under 17 U.S.C. §512(c)(3).
We will not reject DSA notices solely because they lack non-mandatory attachments or because the claimant does not own the rights where the law allows anyone to report illegal content. We may ask for information needed to locate and assess specific material.
3. GAMPEON's handling procedure
GAMPEON acknowledges notices when required, records their receipt, assesses specificity and evidence, identifies the affected UGC, and decides promptly and objectively. Where a report establishes actual knowledge or adequately identifies illegal material, GAMPEON will act expeditiously to disable access or remove it as legally required, without waiting for the uploader to respond. In ambiguous cases, GAMPEON may seek additional detail or creator evidence while taking proportionate interim steps as warranted. Affected parties receive appropriate decisions, reasons and available remedies. Serious repeat violations may lead to project or account restrictions.
Forwarding and privacy: GAMPEON may transmit necessary allegations and evidence to the relevant Uploader or Project Owner to permit a response, but only as lawful and necessary. Complainants' private identifiers are not automatically made public; disclosure needed for a formal DMCA counter-notification process or lawful order may be required. The Platform may facilitate direct resolution without undertaking to decide private licensing disputes beyond its legal duties.
4. What Uploaders and Project Owners must do
Uploaders must preserve and provide valid licenses, permissions or other supporting evidence when requested. Project Owners must cooperate with removal or disablement of material within their technical control, particularly after receiving sufficiently specific notice. Neither a Project Owner nor GAMPEON is automatically responsible solely because a player uploaded content to a project; each remains responsible for its own acts, knowledge, control and mandatory legal duties. Reuploading material removed for infringement, or bypassing restrictions, may lead to suspension.
5. US DMCA-specific notices and counter-notices
To rely on relevant US DMCA §512 safe harbors, a qualifying service provider must, among other things, appoint and register a designated DMCA agent with the US Copyright Office, publish the agent's contact details, adopt and reasonably implement a repeat-infringer policy, and follow applicable notice, takedown and counter-notice requirements. GAMPEON does not represent that registration is complete until it has actually been completed and verified.
Designated agent: GAMPEON has not yet registered a designated DMCA agent with the US Copyright Office. Until it has, send copyright notices to abuse@gampeon.com. That address can receive reports but is not a substitute for statutory designated-agent registration, and GAMPEON does not claim DMCA safe-harbor status before the registration is complete.
A US DMCA counter-notice must include the information prescribed by 17 U.S.C. §512(g), including the submitter's signature, identification of removed content, a statement under penalty of perjury of good-faith belief of mistake/misidentification, contact details, and required jurisdiction/service consent. GAMPEON will forward valid counter-notices to the original complaining party as required. Where the DMCA procedure applies, restoration generally occurs not earlier than 10 and not later than 14 business days after receipt of a valid counter-notice unless GAMPEON receives notification of qualifying court action. This DMCA timetable must not be applied automatically to trademark complaints or non-US proceedings.
6. DSA decisions and appeals
Under applicable EU rules, reporting and notice processes must be accessible, timely, diligent, objective and non-arbitrary. GAMPEON will provide reasoned decisions and information about remedies as required. Users and complainants will have access to statutory review procedures, including the minimum six-month internal complaint period where DSA Article 20 applies, subject to the Regulation's applicable exceptions. Available out-of-court and judicial remedies are unaffected.
7. Abusive reports and repeat infringement
Deliberately false or materially misleading reports, forged ownership claims, repeated manifestly unfounded complaints and repeat infringement may lead to proportionate restrictions subject to legal safeguards. Reporting in good faith is encouraged. GAMPEON may preserve relevant complaint records to fulfill statutory obligations and defend legal claims in line with the Privacy Policy.
8. Court orders and disclosures
GAMPEON complies with binding lawful orders, appropriately reviews third-party requests for personal data and only discloses information on a valid legal basis. This policy does not limit the rights of complainants, creators or GAMPEON to seek judicial relief.
